1. Agreement to These Terms
These Terms of Service (“Terms”) form a binding agreement between you and Momentrove, currently operated by Murat Altuntas, an individual based in Istanbul/Türkiye (“Momentrove,” “we,” “us,” or “our”). They govern your access to and use of the Momentrove event platform, the website at momentrove.com, and related applications and services (the “Service”).
By creating an account, connecting storage, joining an event, or otherwise using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service. If operations later move to a registered company, these Terms will be updated with that entity’s details.
2. Who May Use the Service
- Age: you must be at least 18 years old, or the age of digital consent in your country, to create an account or act as a host.
- Authority: if you use the Service on behalf of an organization, you confirm you are authorized to bind that organization to these Terms.
- Compliance: you are responsible for using the Service in line with all laws that apply to you.
3. How the Service Works
Momentrove lets event hosts (“Hosts”) collect photos from their guests (“Guests”) and manage event features. Momentrove is a conduit, not a photo host: guest photos pass through our servers only momentarily and are delivered into the Host’s own connected cloud storage (such as the Host’s Google Drive). We do not store the image files; we store only descriptive metadata and account/contact details, as described in our Privacy Policy.
Your storage, your responsibility. Hosts connect their own cloud storage. You are responsible for that storage account, its available space, its settings, its security, and compliance with the storage provider’s own terms. Available capacity, file limits, and uptime of that storage are determined by your provider, not by us.
4. Accounts and Security
- Accurate information: you agree to provide accurate account information and keep it up to date.
- Credentials: you are responsible for safeguarding your login credentials and for all activity under your account.
- Notify us: tell us promptly at elmuro61@gmail.com, if you suspect unauthorized use of your account.
5. Hosts, Guests, and Consent
Host responsibilities. As a Host, you control your event, your guest list, your storage, and what is collected and displayed. You are responsible for: obtaining any consents required from Guests and from people who appear in photos (including, where applicable, parents or guardians of children); providing any privacy notices your local law requires; and handling requests from your Guests about their data. Where Momentrove processes data on your behalf, you act as the data controller and we act as your processor.
Guest contributions.As a Guest, you are responsible for the content you upload and for having the right to share it. Content you upload is delivered to the Host’s storage and may be visible to the Host and other participants according to the Host’s settings.
6. User Content and License
You own your content.As between you and Momentrove, you (or the Host, as applicable) retain all rights in the photos and other content you provide (“User Content”). We do not claim ownership of it.
Limited license to operate the Service. You grant Momentrove a limited, non-exclusive, worldwide, royalty-free license to host, transmit, display, and process User Content solely to the extent necessary to operate and provide the Service — for example, to route a photo to the Host’s storage and to display it back to permitted participants. This license is limited to the technical operations the Service performs and ends when the content is removed from the Service, except for transient copies and standard backups that age out.
We do not sell User Content, and we do not use it to train artificial-intelligence models.
7. Acceptable Use
You agree not to use the Service to:
- upload or share content that is illegal, infringing, defamatory, or violates someone’s privacy or rights;
- upload content depicting the sexual abuse or exploitation of minors, or any other illegal content;
- harass, threaten, or harm others, or collect people’s data without a lawful basis;
- upload malware or attempt to gain unauthorized access to the Service or others’ accounts;
- probe, scrape, overload, or disrupt the Service or its infrastructure;
- circumvent access controls, usage limits, or security measures;
- misuse the Service in violation of your storage provider’s or any other third party’s terms.
We may remove content or suspend access that we reasonably believe violates these Terms or the law.
8. Third-Party Services
The Service relies on and integrates third-party services, including your cloud storage and identity providers, and our infrastructure providers. Your use of those services is governed by their own terms and policies. We are not responsible for third-party services, and their availability is outside our control. If you disconnect a required third-party service (such as your storage), parts of the Service may stop working.
9. Fees and Paid Plans
Momentrove offers free and paid plans. Paid plans are processed securely through our authorized payment partner. When you purchase a plan, you agree to the following:
- Single Event Plan ($9.99): a one-time payment for 1 event with premium features, including unlimited uploads, custom QR code branding, guest-list management, and RSVP service.
- Unlimited Month Plan ($19.99/month): a monthly subscription for unlimited events and all features.
- Unlimited Year Plan ($199.99/year): a yearly subscription for unlimited events and all features.
Prices are stated in USD and exclude any taxes that may apply. We may change pricing prospectively with reasonable notice. Payments are handled by our payment partner; we do not store full card details.
Automatic Renewal
Subscription plans renew automatically at the end of each billing cycle. You will be charged the applicable subscription fee unless you cancel before the renewal date. You can cancel at any time through your account dashboard or by contacting us at elmuro61@gmail.com.
Cancellation
You can cancel your subscription at any time through your account dashboard or by emailing elmuro61@gmail.com. Upon cancellation, you will retain access to your current plan features until the end of your billing period. No further charges will be made after cancellation.
Refunds
Except where required by applicable law, fees are non-refundable.
Event Duration
Events created with the Single Event Plan never expire — you can access the event for as long as you need, with no time limit, and features remain active until at least one day after the event date. Events created with an Unlimited Plan remain active for as long as your subscription is active. Regardless of plan status, all uploaded files always remain in your Google Drive.
10. Intellectual Property in the Service
The Service itself — including its software, design, text, and logos (but excluding User Content) — is owned by Momentrove or its licensors and is protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for its intended purpose. You may not copy, modify, distribute, sell, or reverse-engineer any part of the Service except as permitted by law.
11. Availability, Changes, and Beta Features
We aim to keep the Service available but do not guarantee uninterrupted or error-free operation. We may modify, suspend, or discontinue features at any time. Some features may be offered as beta or experimental and provided “as is,” and may be changed or withdrawn.
12. Suspension and Termination
- By you: you may stop using the Service and close your account at any time.
- By us: we may suspend or terminate your access if you breach these Terms, if required by law, or to protect the Service or others.
- Effect: on termination, your right to use the Service ends. Image files remain in your own storage under your control; we may delete associated metadata and account data as described in the Privacy Policy. Sections that by their nature should survive (such as ownership, disclaimers, limitation of liability, and dispute terms) continue to apply.
13. Disclaimers
To the maximum extent permitted by law, the Service is provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free, or that content stored in your third-party storage will be preserved — you are responsible for maintaining your own backups.
14. Limitation of Liability
To the maximum extent permitted by law, Momentrove and its operator will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, content, profits, or goodwill, arising out of or relating to your use of the Service. To the maximum extent permitted by law, our total aggregate liability arising out of or relating to the Service will not exceed the greater of (a) the amount you paid us for the Service in the 12 months before the event giving rise to the claim, or (b) USD 100.
Some jurisdictions do not allow certain limitations, so some of the above may not apply to you. Nothing in these Terms limits liability that cannot be limited by law (for example, for death or personal injury caused by negligence, or for fraud).
15. Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless Momentrove and its operator from claims, damages, and reasonable expenses arising out of your User Content, your use of the Service, your violation of these Terms, or your violation of any law or third-party right.
16. Changes to These Terms
We may update these Terms from time to time. We will post the updated version with a new “Last updated” date and, where the changes are material, provide additional notice. Your continued use of the Service after changes take effect means you accept the updated Terms.
17. Governing Law and Disputes
These Terms are governed by the laws of Türkiye, without regard to conflict-of-laws rules. Disputes will be subject to the courts of Istanbul, Türkiye.
18. Miscellaneous
- Entire agreement: these Terms and the Privacy Policy are the entire agreement between you and us regarding the Service.
- Severability: if any provision is unenforceable, the rest remains in effect.
- No waiver: our failure to enforce a provision is not a waiver of it.
- Assignment: you may not assign these Terms without our consent; we may assign them in connection with a transfer of the Service.
